Stealth Data Privacy Policy

This Privacy Policy (“Privacy Policy “) is a legally binding agreement between the user (“User”, “Client”, or “you“) and Stealth Data, LLC, a Missouri Limited Liability Company with its principal office at 4700 Belleview Ave., Suite 100C, Kansas City, Missouri 64112, USA (“Stealth Data“ or “ID”) operates the www.StealthData.com website and platform and provides services related to the use of the platform or collectively known as “Parties” “We” or “Us”. Please make sure you fully understand the contents of this Privacy Policy.

IF YOU DO NOT AGREE WITH ANY PROVISION OF THIS PRIVACY POLICY, YOU MAY NEITHER CONTINUE WITH THE PROCESS OF PLATFORM REGISTRATION NOR FURTHER USE THE SERVICES.

This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.

By using the Service, you agree to the collection and use of information in accordance with this policy.

Definitions

Service is the www.StealthData.com website and platform operated and maintained by Stealth Data, LLC and its related services.

Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Cookies are small files stored on your device (computer or mobile device).

For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.

Data Subject (or User) is any living individual who is using our Service and is the subject of Personal Data.

Types of Data Collected

Personal Data.  While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to: First name and last name, Email address, Phone number, Address, State, Province, ZIP/Postal code, City, Cookies, and Usage Data. We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

 

Usage Data. We may also collect information on how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

 

Third Party Sources. We may obtain information about you from third-party sources, such as Google, Apple, our clients or other permissible means.  This information may be utilized, analyzed, and/or compared with information that we have collected from you or that you have submitted through your use of the Service. If Stealth Data obtains information from third-party sources, you agree that your sole legal remedy for any harm associated with that information is against the third-party that provided the information to us, and that you will not assert any cause of action, claim or demand against us other than requesting we delete any erroneous information.

Aggregate Data. For the avoidance of doubt, Stealth Data shall be entitled to collect anonymous and/or aggregated data across its various products and services provided that no individual natural person can be identified from such data (“Aggregate Data”). The Aggregate Data will be used to analyse behaviour, trends and needs and to improve, and enhance our services and for other development, creation of new features, diagnostic and corrective purposes in connection with our services. Stealth Data shall own all right, title and interest in and to the Aggregate Data and this is not considered personal data.

Tracking & Cookies Data. We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service. Our cookies generally fall into one of four categories:  Essential, Functional, Analytics and Target.  The Service may contain web beacons (also known as “clear gifs”) or similar technologies that gather non-personally identifiable information about your use of our Service.  Such technology may also be contained in e-mail messages or newsletters from us that allow us to determine whether messages have been accessed.  The purpose of our use of this technology is so that we may analyze the effectiveness of our marketing efforts and the quality of our Service.

    2. To allow you to participate in interactive features of our Service when you choose to do so;

    4.  To gather analysis or valuable information so that we can improve our Service;
    5. To monitor the usage of our Service;

    7. To provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information;
    8. To enforce, this Privacy Policy, other Stealth Data posted policies, enforce Stealth Data agreements, or otherwise manage Stealth Data business;
    9. In connection with any possible sale merger or restructuring of all or any part of our business or assets;
    10. Where we have another legitimate interest in doing so; and
    11. To perform functions as otherwise described to you at the time of collection.

    You acknowledge and agree that Stealth Data may use and disclose your personal and non-personal information to public or private third-parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us; and (iv) to protect our, our users, and others’ rights, property, or safety whether during or after the term of your use of our Service.

     Unless otherwise provided in this Privacy Policy, we shall not disclose Personal Information you submit to us except (i) with affiliates, licensees, subsidiaries and successors, (ii) when we have your permission, or (iii) as necessary to: 

    • To our affiliates as permitted by law;
    • To third parties who provide information technology services such as website hosting, computer systems maintenance, or data security and privacy services;
    • To our partners, vendors or others who help us operate the Service or assess your interest or satisfaction with the Service, our organization, or our products, provided they have contractually agreed to adhere to this Privacy Policy; or

    In addition, we may share aggregate and sell, non-individual information, incapable of identifying a particular person, with third parties for any lawful purposes.

      Retention of Data

      Stealth Data, LLC will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. Stealth Data, LLC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

      Transfer of Data

      Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Stealth Data, LLC will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

      Security of Data

      The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

      Service Providers

      We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used. The third parties listed below have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose:

      Analytics

      Google Analytics – a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.       Links to Other Sites

      Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services. Stealth Data cannot guarantee or verify the contents of any externally linked website. You should therefore note you click on external links at your own risk and Stealth Data cannot be held liable for any damages or implications caused by visiting any external links. This Privacy Policy does not cover any third party’s use or handling of your information once it is shared.  Instead, the privacy policy of the third-party will govern. We strongly encourage you to visit the websites of those third-parties and fully read and understand their privacy policies.  Some of these entities will have different privacy terms than we do and their servers may be located outside the United States.

      Communications from Us

      Unless you opt out of certain communication features, we may use your information to communicate with you, such as through e-mail, newsletters, and telephone.  You may opt out and/or unsubscribe to communications at any time.  See the Opt-Out Provisions and Updating Your Information section below for applicable contact information and directions.

      You may contact Stealth Data to review, update and correct your Personal Information.Our emails will include a link to opt-out from receiving further electronic communications from us. At places on our website where you give us your personal information, you may opt out of receiving those communications. You may also opt out of future electronic communications by contacting us as provided below.

      We may need to verify your identity before providing you with Personal Information or updating it in our system

      Childrens Policy

      The Service is meant for adults and those who have reached the age of majority as defined by the laws of their domicile. The Service is not meant for individuals under the age of eighteen (18) or those defined by the laws of their domicile as minors.  Nonetheless, this Privacy Policy is still designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) to the extent COPPA applies to Stealth Data.  Accordingly, Stealth Data does not knowingly collect or retain any personal information about users under the age of information about a child under the age of 13, that information will be promptly deleted from our databased and all other media.  Since we do not collect information from users who are under 13 years old, no such information is disclosed to third-parties.

      California Privacy Rights

      We will not share any personal information about you with other companies if prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law.

      If you are a California resident, you may have certain rights with respect to your Personal Information including the following rights:

      1. the right to know, by way of our Privacy Policy and any specific inquiries you direct to us, where personal information we have about you comes from, what we use that information for, whether it is being disclosed or sole, and to whom it is being disclosed or sold;
      2. the right to “opt-out” of Stealth Data’s sale of your personal information to any third parties;
      3. the right, with some exceptions, to have your personal information deleted from Stealth Data’s possession or control; and
      4. the right to receive equal service and pricing from Stealth Data even if you exercise any of your privacy rights.

      EU Resident Rights Under the GDPRs

      These disclosures apply only to our processing of Personal Information within the scope of the General Data Protection Regulation (“GDPR”) from one or more of the European Union Member States plus Iceland, Lichtenstein and Norway (together known as the “European Economic Area” or “EEA”). 

      The GDPR went into effect on May 25, 2018.  As a resident of the EU or EEA, you have certain rights with respect to the processing of your personal data, including:

      • Your right of access – You have the right to ask us for copies of your personal information.
      • Your right to rectification – You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
      • Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
      • Your right to restriction of processing – You have the right to ask us to restrict the processing of your information in certain circumstances.
      • Your right to object to processing – You have the the right to object to the processing of your personal data in certain circumstances.
      • Your right to data portability – You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

      You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

      Stealth Data, LLC’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. Stealth Data, LLC may process your Personal Data because:

      • We need to perform a contract with you;
      • You have given us permission to do so;
      • The processing is in our legitimate interests and it is not overridden by your rights; or
      • To comply with the law

      This Privacy Policy may be updated from time to time.  We reserve the right to modify the Policy at any time without notice, so please review the Privacy Policy frequently.  When changes are made to this Privacy Policy, we will revise the “last updated” date at the bottom of this Privacy Policy.  Your continued use of our Service after we have posted any policy changes indicates your agreement to the changes unless you notify us otherwise.
